Statutory Demands And Winding Up Petitions That Get Results

Serious commercial pressure on companies that can pay an undisputed debt but choose not to.

When a company ignores your invoices but is clearly trading, a statutory demand followed by a winding up petition is often the fastest route to payment. A company that fails to pay within 21 days of a statutory demand for an undisputed debt of £750 or more is deemed unable to pay its debts - and faces being wound up.

This is not a route for disputed debts, and used wrongly it exposes you to an injunction and adverse costs. We assess whether the debt is genuinely undisputed, serve the statutory demand correctly, and proceed to petition where appropriate.

What does Statutory Demands and Winding Up Petitions involve?
We draft and serve a statutory demand giving the debtor 21 days to pay. If unpaid and undisputed, we advertise and present a winding up petition in the appropriate court, which - once advertised - typically freezes the company's bank accounts and forces urgent payment or negotiation.
How much does Statutory Demands and Winding Up Petitions cost?
A statutory demand is a fixed cost. A winding up petition carries a court fee, an Official Receiver's deposit and legal fees, which are recoverable from the debtor if the petition succeeds. We set out all costs before proceeding.
How long does Statutory Demands and Winding Up Petitions take?
The statutory demand gives 21 days to pay. Many debts are paid within that period. If a petition is needed, hearings are typically listed six to ten weeks after presentation, though payment often follows the advertisement of the petition.
